1. Acceptance of Terms

These Terms of Use ("Terms") govern your access to and use of the mobile application WODR - Workout of the Day (WOD) & HIIT Generator, operated by Black Ueli GmbH ("we", "us", or "our").

By accessing or using WODR, you agree to be bound by these Terms. If you do not agree, do not use the app.

Our Privacy Policy also governs your use of the app and describes how we collect, process, and protect your personal data.

2. Eligibility

You must be at least 16 years old or have the consent of a parent or legal guardian to use the app. By using WODR, you represent and warrant that you meet this requirement.

3. User Accounts

To access core features of WODR, you may need to create an account. You agree to:

• Provide accurate and complete information
• Maintain confidentiality of your login credentials
• Notify us of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscriptions & Billing (If Applicable)

Some features of WODR may be offered on a subscription basis. Terms of payment, renewal, and cancellation will be disclosed at the time of purchase. Subscriptions are handled through your app store account (Google Play or Apple App Store).

5. Content and User Conduct

You may upload progress data, photos, or other content to WODR. You retain ownership of your content but grant us a non-exclusive, worldwide license to use it solely to provide and improve our services.

You agree not to:

• Post illegal, offensive, or harmful content
• Use the app to harass or defame others
• Reverse-engineer, copy, or misuse any aspect of WODR

We reserve the right to remove content or suspend access that violates these rules.

6. Intellectual Property

All content, features, and functionality of WODR (excluding user-generated content) are the intellectual property of Black Ueli GmbH and protected under copyright, trademark, and other applicable laws.

You may not:

• Modify or distribute the app or its content
• Use our branding without written permission
• Attempt to extract source code or replicate features

7. Third-Party Services

WODR may link to or integrate third-party services in the future (e.g., analytics or cloud hosting via Supabase). We are not responsible for the practices of these services. Please refer to their own terms and privacy policies.

8. Disclaimers

WODR is provided "as is" and "as available." We do not guarantee that the app will be error-free, available at all times, or suitable for your fitness goals.

We are not liable for:

• Loss of data
• Health or injury risks from following app advice
• Indirect or incidental damages

You should consult with a medical professional before beginning any fitness program.

9. Limitation of Liability

To the extent permitted by law, our total liability to you will not exceed CHF 50. We are not liable for indirect, consequential, or special damages arising from your use of the app.

10. Termination

We may suspend or terminate your access to WODR at our discretion, particularly for violations of these Terms. You may also delete your account at any time by contacting us.

11. Governing Law

These Terms are governed by the laws of Switzerland. If you are an EU resident, you may also have rights under the laws of your country.

In the event of a dispute, the competent courts in Basel, Switzerland, shall have jurisdiction, unless local law grants you mandatory protections in your jurisdiction.

12. Amendments

We may update these Terms from time to time. If we make material changes, we will notify you through the app or via email. Continued use of WODR after such changes constitutes your agreement to the updated Terms.
